12. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any dispute arising out of or in relation to these Terms shall first be referred to mediation. If the dispute remains unresolved within 30 (thirty) days of the commencement of mediation, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator to be mutually appointed by the parties within 30 (thirty) days of either party issuing a written notice invoking arbitration. If the parties are unable to mutually agree upon the sole arbitrator within that period, the arbitrator shall be appointed in accordance with the Arbitration and Conciliation Act, 1996, including any application made under Section 11 thereof before the jurisdictional High Court. The seat and venue of arbitration shall be Hyderabad, Telangana, India, and the language of arbitration shall be English. Nothing in this clause shall preclude either party from seeking interim relief from a court of competent jurisdiction in Hyderabad, Telangana.
